Privacy Notice

I. Identity and Address of the Controller.

Based on the current provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the "Law"), through this privacy notice (the "Privacy Notice"), we inform the person, client and/or supplier to whom the Personal Data corresponds (the "Holder") that the personal information that you provide to us, either personally or directly by any electronic, optical, sound, visual means or through any other technology or by any other means in the course of interactions with us (the "Personal Data"), may be collected and stored by us for the purposes referred to in this Privacy Notice.

For the purposes of the Personal Data that your case has provided or may provide through printed, digital, visual, audio or any social network or technological means and due to the relationship or possible relationship through the use of our services, Hope IVF, S. de R.L. de C.V. and Chavez Medical, S. de R.L. de C.V. (jointly or separately “Hope IVF”), with address at [Avenida Ottawa 1568, Piso 6, Colonia Providencia, Guadalajara, Jalisco, C.P. 44630], telephone number [01 (33) 3817 0404], which has business hours from [08:00 to 18:00 hrs], and with website [] (the “Website”); is responsible for the processing of your personal data in accordance with this Privacy Notice.

II. Purpose of the Processing of Personal Data

The Personal Data we collect from the Data Subject will be used for the following primary purposes:

a) Identification of the Holder;

b) Corroboration of information provided by the Owner;

c) Contact the Owner by telephone to arrange medical appointments and answer general questions related to the services that Hope IVF offers;

d) Provide medical services in the specialties of gynecology and obstetrics;

e) Integration, preparation, analysis, updating and preservation of the clinical record;

f) Integration and preparation of the client and supplier file for the execution of the company's purposes;

g) Control, billing and collection of products and services provided;

h) Manage and issue the payment receipts or tax vouchers that correspond in favor of the Holder;

i) Ensure the security of Hope IVF staff and facilities through the video surveillance system and, in the event that any legal right is violated, be able to identify the person responsible for such violations;

j) Manage medical reports provided to the family member or the person designated by the patient to receive such information;

k) Carrying out epidemiological studies, analysis, statistics, registration or any other purpose that the competent authorities require;

l) Remote patient care through any electronic, optical or other technological means;

Additionally, we will use your personal data for the following secondary purposes:

a) Record keeping for future provision of services;

b) Statistical analysis of market and social impact;

c) Provide you with information about products and/or services provided by Hope IVF; and

d) Apply satisfaction and quality surveys for the services provided by Hop IVF.

It is important to mention that in collecting Personal Data we follow the principles established by Law (Article 6): legality, quality, consent, information, purpose, loyalty, proportionality and responsibility.

In the event that the Holder does not wish Hope IVF to process their personal data for the secondary purposes indicated in the previous section, they will have a period of 5 (five) days to express their refusal in writing to the following email recepcion@hopeivf.mx

Refusal to use your personal data for secondary purposes cannot be used as a reason to deny you the requested services or terminate the relationship established with us.

For the aforementioned purposes, Hope IVF will collect and process the following Personal Data:

    • Name of the relative
    • Relationship of the relative
    • Address of the relative
    • Telephone number of the relative
  • Additional documents and data:
    • Current government-issued ID information
    • Proof of address information
    • Proof of income information
    • Handwritten signature
  • Other documents that are necessary for the purposes mentioned in section II above.

IV. Processing of Sensitive Personal Data.

In order to provide medical care, it is necessary to process Personal Data that, due to its characteristics, is considered sensitive and related to the subcategories of health, ideology, and sexual life data.

The processing of this category of personal data requires your express consent.

V. Transfer of the Data Subject's Personal Data.

The Personal Data referred to in this Privacy Notice may be transferred to:

a. Mexican and foreign judicial authorities, for the purpose of complying with notifications, requests, and judicial orders.

b. Administrative authorities, in order to comply with obligations contained in current legislation.

c. Service providers and advisors who assist Hope IVF in providing the Services. The service providers and advisors to whom such data will be transferred are laboratories, Hope IVF clinics, and insurers.

Likewise, Hope IVF will not communicate, share, or in any way transfer the Personal Data collected, whether within or outside the national territory, to third parties except in the cases listed above. If we make any additional transfer that requires your express consent, it will be obtained beforehand.
The consent of the Data Subjects will not be necessary when the transfers are necessary to provide a service or keep clinical records updated.

VI. Means and/or Procedure for Exercising the Rights of Access, Rectification, Erasure, and Objection ("ARCO").

The Owner will have the right to access the Personal Data that Hope IVF has collected from him, on business days and hours, upon written request made directly to Hope IVF, addressed to [Mariana Calderón Montaño], head of the Personal Data Protection Department of Hope IVF, at the email address [recepcion@hopeivf.mx]. To ensure its correct receipt, we request that you confirm the sending of the request by phone to the phone number [01 (33) 3817 0404], with a business hours of [08:00 to 18:00 hrs]. Likewise, you have the right to rectify your Personal Data if it is incomplete or inaccurate, as well as to delete it from Hope IVF's records at any time, except in cases established in Article 26 (twenty-six) of the Law. Finally, you may object to the processing of your Personal Data for specific purposes.

In order to exercise any of the aforementioned rights, the Data Subject must submit a written request by email, which must contain:

a. The Data Subject's full name, address, and email address for the purpose of communicating the response to your request.

b. A copy of official identification to prove the Data Subject's identity (voter's ID, passport, professional license) or, in the case of representation, the identification documents of the legal representative with sufficient and necessary authority for the purposes in question.

c. A clear and precise description of the Personal Data for which you wish to exercise any of the rights of access, rectification, erasure, and/or objection to processing, or for certain purposes of processing, or for which you wish to revoke consent.

d. To rectify your name, attach a copy of proof if it is different from the official identification presented to prove your identity.

e. Any other document or element that facilitates locating the Personal Data subject to the exercise of any of the aforementioned rights.

In the case of requests related to the exercise of the aforementioned rights, in addition to including the information described above, the interested party must describe the Personal Data to be rectified or erased and include the information and documents that support their request.

Hope IVF must respond to the request described within a period not to exceed 20 (twenty) business days from the date of receipt of said request. If the Data Subject's request meets all the requirements and is therefore appropriate, Hope IVF will have a period not to exceed 15 (fifteen) business days from the date of communication of the response indicated above to process the request.

VII. The Use of Cookies, Web Beacons, or Any Other Similar or Analogous Technology.

We inform you that, through our Website, we use cookies, through which it is possible to monitor your behavior as an Internet user, as well as provide you with a better service and experience when browsing our page.

VIII. Modifications to the Privacy Notice.

Hope IVF reserves the right to make any type of modification or update to this Privacy Notice in order to fully comply with new legal provisions, new internal policies, or requirements of any competent authority. These modifications and/or updates will be announced immediately after their entry through our Website or through a publication of the updated version of the Privacy Notice in this section.

Within 5 (five) calendar days after the effective date of this Privacy Notice or, where applicable, any subsequent updates, you must express your opposition to the processing of your Personal Data by Hope IVF through a request sent to the email address: recepcion@hopeivf.mx. After the aforementioned period has elapsed, your tacit acceptance of the guidelines and provisions established in this Privacy Notice will be deemed.

IX. Rights Protection Procedure.

If the Data Subject believes that their right to the protection of their Personal Data has been violated by a member of Hope IVF or that any of the requirements established by law have been violated, they may file a complaint or claim with the National Institute for Transparency, Access to Information, and Data Protection ("INAI") or, where applicable, the designated institutional entity.
